In civil law there are many agreements/contracts, civil court proceedings concerning civil matters must be translated into English as the international language because one of the parties is a foreigner. In the criminal field, where the defendant is a foreigner, the translation of legal documents such as power of attorney, defense, to court decisions, is also very necessary.
This happens a lot in drug abuse cases, because many of the defendants are not Indonesian citizens, but they have to deal with Indonesian procedures and laws as a place of crime (locus delicti). All legal processes regulated in Indonesian must be understood by the relevant parties, from the suspect to his legal adviser. In this case, the translation of legal rules into proper English is very necessary, for the sake of legal protection.
Foreign Citizens in Indonesia who are doing business in Indonesia should also understand Indonesian law. The role of a legal translator in this case is very important. In Indonesia, a legal translator must be sworn in by the Indonesian government through the Ministry of Law and Human Rights after passing a series of examinations.
On the other hand, a translated work is also recognized as having its own level of originality so that it deserves copyright protection regardless of the copyright protection of the original work. This is stated in Article 12 paragraph 1 letter (1) of Law No. 19 of 2002 concerning Copyright, that the translation together with interpretations, adaptations, anthology, databases, and other works resulting from the conversion is recoqnized as one type of work Copyright protected. In the next paragraph, it is explained that the protection of the works resulting from the conversion is given as if it were a separate work, and without prejudice to the Copyright of the original work.
